General Criteria – Branch Office

A body corporate incorporated outside India (including a firm or other association of individuals), desirous of opening a Branch Office (BO) in India have to obtain permission from the Reserve Bank under provisions of FEMA 1999. - Application in the prescribed Form FNC shall be filed (WMC to be provide post receipt of information as per this checklist)

  1. Parent company must have a profit making track record during the immediately preceding five years and net worth of not less than USD $100,000 or its equivalent

  4. A certificate from the auditors of the parent company that the net worth of the parent co is more than $ 1,00,000
  5. The identity and address proof of the responsible person to do compliance for the branch office.
  6. Premises proof of the registered office of branch office and an NOC from the owner of such premises
  7. In case the document is in the foreign language, then a certified translation thereof must be filed.
